Social Security Disability and Workers’ Compensation

by | Jan 7, 2011 | Social Security Disability |

It is fairly common for Social Security disability claimants to also have workers’ compensation claims. If you have a pending workers’ compensation claim or a recent workers’ compensation settlement, it is important to know that the money you received due to workers’ compensation can result in a reduction of your Social Security disability benefits. According to Social Security’s frequently asked questions, the amount is calculated as follows:

“The Social Security disability benefits you and your family receive are reduced if the combined total amount, plus your workers’ compensation payment, plus any public disability benefit payment you receive exceeds 80 percent of your average pre-injury/illness earnings.”

In order to calculate what your Social Security disability benefit payment should be, the Social Security Administration will need all of the paperwork concerning your workers’ compensation payments and/or settlement. Therefore, it is important that you keep track of any paperwork regarding your workers’ compensation case.

An experienced Social Security disability attorney can help answer questions regarding how your workers’ compensation case may affect your Social Security disability benefits. For more information, click here to read the pamphlet published by the Social Security Administration.
