For individuals filing for Social Security Disability, usually there is a 5-month waiting period before you began to receive any monetary disability insurance benefits (DIB). Additionally, an individual must wait 24 months before receiving any Medicare benefits.
For those with ALS (amyotrophic lateral sclerosis), the ALS Disability Insurance Act ends the five-month wait period for Disability Benefits for those with ALS. Congress passed, and the President signed into law, the ALS Disability Insurance Act of 2019 which is legislation that ends the five-month waiting period for disability insurance benefits (DIB) for anyone with amyotrophic lateral sclerosis (ALS), also called Lou Gehrig’s disease, beginning in December 2020. This only applies for DIB claims filed on or after December 23, 2020. Previous legislation had already ended the 24-month waiting period for Medicare for beneficiaries diagnosed with ALS.
On January 21, 2021, the Social Security Administration published announcements for staff on claims where ALS is alleged. ALS also falls under the compassionate allowance cases.
