Recent Appeals Council Remand

by | Feb 14, 2011 | Social Security Disability |

I recently received a Remand Notice from the Appeals Council remanding a case to the Administrative Law Judge. A few months ago, someone walked into my office with an Unfavorable Decision she recently received from an Administrative Law Judge. She had filed a claim for Disability Insurance Benefits and Supplemental Security Income. This person was not represented at the hearing and asked if I could help her. I went over the Unfavorable Decision with her and also the evidence she brought. Reading over the evidence, I noticed something just did not seem right about the Unfavorable Decision. I took the case and immediately appealed it to the Appeals Council. It seems the Administrative Law Judge did not consider all the evidence when deciding the case and did not properly consider the claimant’s mental impairments. The Appeals Council agreed and now my client is preparing for a second hearing.

If you have received an Unfavorable Decision from an Administrative Law Judge, please talk to an experienced disability attorney about a potential appeal.

“These recoveries and testimonials are not an indication of future results. Every case is different, and regardless of what friends, family, or other individuals may say about what a case is worth, each case must be evaluated on its own facts and circumstances as they apply to the law. The valuation of a case depends on the facts, the injuries, the jurisdiction, the venue, the witnesses, the parties, and the testimony, among other factors. Furthermore, no representation is made that the quality of the legal services to be performed is greater than the quality of legal services performed by other lawyers.”
