Secret ALJ’s

Since January 2012, the Social Security Office of Disability Adjudication & Review has been withholding the name of the ALJ for all upcoming disability hearings. We feel that this is much to the detriment of both representatives and claimants. But hopefully a change is forthcoming. The Commissioner of the Social Security Administration has sent a proposed notice of proposed rulemaking to the Office of Management and Budget (OMB) for review. The reason for the proposed rule states: “These proposed rules would protect the integrity of our programs and address public concerns regarding the removal of an administrative law judge’s name from the Notice of hearing and other prehearing notices.” Here’s hoping for a change in the “Secret ALJ” rule in the near future.
