Medical Evidence is Key in Your Claim for Social Security Disability Benefits. An Experienced Attorney Can Help.

Many claimants for Social Security Disability and SSI benefits want to know what they can do to help their lawyer win their case or to speed up a decision on their claim. Over the past 37 years the most frequent advice that I give is to have a medical doctor and to see him on a frequent basis. In most instances the only secret to wining a disability claim is to have your lawyer submit to the Social Security Administration the written opinion in proper form of your treating physician. This opinion should provide your diagnosis, the severity of your symptoms, and physician's opinions concerning your ability to engage in work related physical and/or mental activities on a sustained basis. Documentation is the key to winning your claim for Social Security Disability benefits.

It is the claimant's responsibility to see his or her doctor and the Social Security lawyer's responsibility to submit this information to the judge that will decide your case.

If you do not have medical insurance or cannot afford to see a doctor, then an experienced Social Security attorney can help you by recommending the public health clinics and other medical sources that provide competent care to those who have been refused treatment because of their lack of resources. An attorney can also request that the Social Security Administration send a claimant for a consultative medical or psychological examination to be paid for by the Social Security Administration.

The most important thing is that you see your doctor often enough so that he has had the opportunity to order the proper tests, observe your response to treatment, and observe your compliance with his instructions. This will insure that he has enough information that he can form an opinion about your physical and mental limitations resulting from the conditions for which he treats you. Most Social Security Disability and SSI claims are lost because the claimant has not provided enough medical evidence to support his or her claim for disability.
