How to Fight a VA Rating Reduction or Benefits Severance

How to Fight a VA Rating Reduction or Benefits Severance

As a member of the National Organization of Veterans' Advocates (NOVA) I attended a webinar presented by NOVA regarding one of the great challenges facing Veterans and their advocates: rating reductions and benefits severance.

All too often the VA will propose to reduce or sever benefits that a Veteran is entitled to and has been receiving for a significant period of time. We see these kinds of cases on a regular basis at our firm and constantly advocate for our Veterans to avoid or reverse any reduction or severance of benefits. Today's webinar provided an in-depth discussion of, not only the challenges, but the solutions concerning reduction and severance of benefits.

As in many cases, the VA does not always take the appropriate steps to notify the Veteran of a proposed severance or reduction, and often the action by taken by the VA is improper on a number of grounds found in VA regulations and federal law. NOVA's webinar today provided helpful practice tips and discussion of the most common errors made by the VA in actions for reduction and severance so that we can better advocate for our Veterans. We look forward to putting this information to good use as we continue to fight for our Veterans in an effort to obtain all VA benefits that they are entitled to under the law.

If you have received a proposal, or a final reduction or severance of benefits, please contact the experienced Veterans' disability attorneys at Gardberg & Kemmerly, P.C. today for a free case evaluation.
